The environmental factor in Galician ventures

The analysis of your company should not be limited to checking profitability, growth projections, and financial stability through its ratios. In recent years, it has become essential to incorporate environmental sustainability as a fourth evaluation axis, because it impacts regulatory risk, access to financing, relationships with clients, and competitiveness. Measuring margins, liquidity, and leverage, alongside verifiable environmental indicators such as resource consumption, emissions, waste management, and regulatory compliance, offers a more complete view and prepares the company for solid growth.

In Spain, Law 7/2022 sets the national framework for waste and soil management, while Royal Decree 1055/2022 governs packaging. In the specific case of Galicia, the management of discharges into public hydraulic domains falls under the Galician Water Law and its authorization procedures via the Xunta’s electronic headquarters.

If your SME generates waste, you must register and operate with official traceability, distinguishing hazardous from non-hazardous waste. The frequency of your reports and the level of detail depend on the type of waste and the activity threshold. The Waste Law also reinforces producer responsibility, meaning your obligation does not end when you hand over the waste, but when you can demonstrate its proper management. This requires reviewing at least once a year that your waste managers are authorized, that transport routes are as declared, and that the chronological archive matches invoices and collection reports.

Additionally, if you have packaged products on the market, the packaging regime affects you both in the domestic channel and in the commercial and industrial sectors. The Packaging Royal Decree requires registration in the Product Producer Registry, declaration of data, and organisation of extended producer responsibility. From 2025 onwards, the obligation to finance and manage commercial and industrial packaging has been reinforced, requiring distributing, importing, or packaging SMEs to review their registration and declarations.

Incorporating these obligations into your venture can prevent fines for errors or lack of communication, which would not only financially affect the company but, even worse, could cause reputational damage that is difficult to recover from.
